حریم خصوصی کودکان اشخاص مشهور در بستر رسانه‌های نوین

چکیده

امروزه رشد فناوری‌های نوین در حوزۀ رسانه‌ها، به‌ویژه ظهور شبکه‌های اجتماعی، موجب شده است فرایند دریافت اطلاعات و سپس انتشار آن‌ها تسریع شود. یکی از موضوعات موردتوجه مردم در شبکه‌های اجتماعی زندگی اشخاص مشهور است. مسلماً، یکی از اجزای مهم زندگی این اشخاص کودکان آن‌ها هستند و رسانه‌ها با، توجه به علاقۀ مردم به دانستن دربارۀ کودکان اشخاص مشهور، می‌کوشند اخباری از آن‌ها منتشر سازند. اشخاص مشهور، به‌عنوان والدین این کودکان، به حریم خصوصی کودکان خویش استناد می‌کنند و رسانه‌ها نیز، به‌حق خویش برای بیان آزادانۀ اطلاعات. اینک، پرسش اصلی این است: نظر به تزاحم این دو حق، کدام‌یک ترجیح دارد؟ برای پاسخ به این سؤال نگارندگان با روشی توصیفی ـ تحلیلی به شناسایی چهار دیدگاه پرداخته‌اند. برخی حریم خصوصی و مصلحت کودک را ارجح دانسته‌‌اند و گروهی به ارزش آزادی بیان توسل جسته‌‌اند و انتشار اطلاعات اشخاص مشهور را موجب تأمین منافع عمومی می‌دانند. گروهی دیگر نیز میان نوع شهرت یا نوع مکان تفکیک قائل‌اند؛ اما گروهی، در نظریه‌ای تحت عنوان توازن، به دنبال ارائۀ معیارهایی هستند که قاضی بتواند در هر پرونده با استفاده از این معیارها توازنی بین حق حریم خصوصی و آزادی بیان برقرار کند. در حقوق ایران، ضمن به‌رسمیت‌شناختن هر دو حق، درخصوص تزاحم آن دو سخن صریحی به‌میان نیامده است. به‌نظر می‌رسد نمی‌توان قاعدۀ ثابتی در این خصوص تأسیس کرد، بلکه بسته‌به شرایط هر پرونده، قاضی باید بررسی کند و حقی را بر دیگری ترجیح دهد که از اهمیت بیشتری برخوردار است.

Today, the growth of new technologies in the field of media, especially the emergence of social networks, has accelerated the process of obtaining information and then spreading it. One of the topics that people pay attention to on social networks is the life of famous people. Undoubtedly, one of the important parts of these people's lives is their children, and the media tries to publish news about them due to people's interest in knowing about the children of famous people. Famous people, as the parents of these children, have invoked their children's privacy, and the media also have the right to express information freely. Considering the conflict between these two rights, the main question is, which one is preferable? To answer this question, the authors have identified four perspectives with the help of a descriptive-analytical method. In the opinion of some, the privacy and interests of the child are preferred, and a group of people resort to the value of freedom of speech and consider disseminating information about famous people to ensure public interests. Another group differentiates between the type of fame and the type of place. Still, a group in theory called balance seeks to provide criteria that the judge can establish a balance between the right to privacy and freedom of expression in each case using these criteria. In Iranian law, while both rights are recognized, there is no explicit statement regarding the conflict between them.
