تأملی بر ماهیت تعهدات دولت‏ ها در قبال حق توسعۀ اقتصادی ناشی از فناوری هسته ‏ای

چکیده

حق توسعۀ اقتصادی جلوه‌ای از توسعه است که در ادبیات حقوق بین ‏الملل مورد توجه قرار گرفته است. این حق به‏ منزلۀ یکی از حقوق اولیۀ دولت ‏ها و نتایج طبیعی حاکمیت آن‏ ها موضوعیت می‏ یابد و از حقوقی است که منشور ملل متحد بر آن استوار شده است و به ‏موجب آن، دولت‏های جهان متعهد شده ‏اند در حل مسائل مربوط به امور اقتصادی، اجتماعی و فرهنگی یا به ‏طور کلی توسعه با یکدیگر همکاری کنند. پرسشی که مطرح می‏شود این است که ماهیت این تعهد و تکلیف دولت‏ ها در برابر حق توسعۀ اقتصادی دیگر کشورها خصوصاً درمورد توسعۀ دانش و فناوری صلح ‏آمیز هسته ‏ای چیست؟ با وجود ادعای کشورهای توسعه ‏یافته مبنی بر نبودن قواعد یا کنوانسیون الزام ‏آور بین‏ المللی درخصوص تعهد به همکاری و کمک به کشورهای درحال توسعه، با توجه به این‏که حق توسعه جزو ارزش ‏های بنیادین بشری و در قالب تعهدات منشور به‏ صورت کلی مقرر شده است، این پژوهش‏ نشان می ‏دهد تا زمانی که فعالیت‏های اقتصادی کشورها ازجمله در زمینۀ انرژی هسته‏ای تهدیدی واقعی برای صلح و امنیت بین‏المللی و منطقه ‏ای نباشد می‌شود آن رابه ‏عنوان تعهداتی ایجابی و مثبت از جانب دولت‏ های توسعه ‏یافته و هسته ‏ای ‏در قبال کشورهای درحال توسعه برای همکاری و انتقال دانش و فناوری صلح ‏آمیز هسته‏ ای تلقی کرد. بر همین مبنا، نوشتار حاضر با رویکردی توصیفی و تحلیلی در پی کنکاش و پاسخ‏گویی تفصیلی به پرسش مذکور است.

چکیده [English]

The right to economic development is considered another manifestation of the development issue in international law literature.  It is considered one of the fundamental rights of governments and the natural result of their sovereignty, and one of the rights upon which the United Nations Charter is based, by which the governments of the world commit to solving economic, social, cultural, and development-related issues in cooperation. Despite this, the question raised here is, what is the nature of this commitment and duty of governments towards the right of economic development of other countries, especially regarding the development of peaceful nuclear knowledge and technology? According to our results, despite the claims of developed countries that there are no binding international laws or conventions stipulating the commitment to cooperation and assistance to developing countries, developing countries have a right to development, and although the obligations of the charter are outlined in a general way, as long as the economic activities of the countries, including in the field of nuclear energy, do not pose a threat to the peace and security of other nations, they may be considered positive obligations. The development of peaceful nuclear technologies and the transfer of knowledge to developing countries are the responsibility of nuclear and developed countries. Based on this, the present article, with a descriptive and analytical approach, seeks to explore and give a detailed answer to the above question.
