متاورس؛چیستی و چالش‌های حقوقی (اداره، اشخاص و اموال)

چکیده

متاورس دنیای غوطه‌ور نیمه‌مجازی، نیمه‌واقعی، سه‌بعدی، مشاعی، فرامرزی و اجتناب‌ناپذیری است که به‌صورت حیرت‌آور و چه‌بسا ترسناکی بر وسعت دنیای مادی افزوده و، در آن، می‌توان فعالیت‌های گسترده‌ای را به‌کمک سرویس‌های واقعیت ‌افزوده و واقعیت ‌مجازی انجام‌ داد. در متاورس، انسان‌ها بدون آن‌که الزاماً هویتشان برای یکدیگر و حتی دولت‌ها مشخص باشد، از طریق آواتارها و به‌لطف رمزارزها و سایر فناوری‌های‌ نوین، به طیف وسیعی از نیازهای اجتماعی، اقتصادی، آموزشی، عاطفی، روانی و حتی جسمی و جنسی خود پاسخ خواهند ‌داد. متاورس فضاهای متنوعی با قوانین و مخاطبان متفاوتی را به هم پیوند می‌دهد که نتیجتاً جوامع سایبری نوینی هم‌تراز با دنیای مادی ایجاد خواهد کرد. به‌واسطهٔ فقدان تجربیات قبلی، هنجارهای متفاوت و ویژگی‌های منحصربه‌فرد و پویای متاورسی نحوهٔ ادارهٔ این فضا بسیار چالش‌برانگیزتر از دنیاهای واقعی و مجازی فعلی است. دولت‌های پیشروی جهان به‌خوبی به پتانسیل‌های نهفته در متاورس از کوچک‌ترین مسائل خانوادگی تا حاکمیت کشورها پی‌ برده‌اند و به‌درستی خواستار تضمین امنیت و حقوق شهروندان و قدرت حاکمیتی خود در فضای متاورس هستند. بسیاری از دولت‌ها نیز مطالعه، سیاست‌گذاری و جرم‌انگاری پیش‌دستانه در موضوع متاورس را آغاز کرده‌اند و اقدام فوری ایران در این زمینه نیز حیاتی است. این تحقیق، ضمن تشریح چیستی متاورس، سعی کرده پاره‌ای از چالش‌های خاص حاکمیتی و حقوقی دنیای متاورس را شناسایی کند و نهایتاً به این نتیجه رسیده که، علاوه بر در نظر گرفتن سیاست‌ها و قوانین نوین، نیازمند تعریف جدیدی از اشخاص تحت عنوان «اشخاص مجازی» هستیم تا بتوانیم به پاره‌ای از چالش‌های نوظهور دنیای متاورس پاسخ دهیم.

چکیده [English]

Metaverse is an immersive, semi-virtual, semi-real, three-dimensional, shared, cross-border and inevitable world, extending our real world in a surprising and perhaps frightening way. Metaverse will likely make it possible for individuals to respond to a wide range of social, economic, educational, emotional, psychological, physical, and sexual needs through avatars and cryptocurrencies or other new technologies without revealing their true identity. Due to the lack of previous experiences, different norms and unique characteristics of the Metaverse, managing the Metaverse is much more challenging than the current real and virtual worlds. Developed governments of the world have well realized the potential hidden in the Metaverse, from the smallest family issues to the selection of leaders and the countries' governance. With foresight, they seek to guarantee their citizens' security and rights and their sovereign power in the metaverse space. Without a doubt, preemptive policy and premeditated criminalization in the Metaverse are vital. While explaining what the Metaverse is, this research has tried to identify some of the specific governance and legal challenges of the Metaverse and finally concluded that today we need a new definition of persons called "Virtual Persons" in order to respond to some of the emerging challenges of the Metaverse world.
